Communication INAI/112/20 issued on April 7, 2020, by the National Institute of Transparency, Access to Information, and Protection of Personal Data (INAI).
Francisco Javier Acuña Llamas, Commission President of the INAI, affirmed that INAI is watching that the authorities provide the society with timely information to face the pandemic and that the right to personal data protection is ensured under all circumstances.
He also assured that the INAI is vigilant to ensure that the privacy of individuals, especially patients diagnosed with COVID-19, is guaranteed.
He warned that geolocation could be used in Mexico as long as the person authorizes or acknowledges this possibility. Therefore, if there is a need to resort to this resource to contain the pandemic, the authorities must do it according to specific protocols, channels, and situations, which INAI must verify. ”
Francisco Javier Acuña pointed out that, as a guarantor of access to information and personal data protection rights, the INAI is a useful institution for society in the face of the health emergency.
