Regarding the import of goods subject to compliance with the Official Mexican Standards (NOM), from what date will it be possible to import goods with the applications submitted before the Certification Body (CB) or Verification Unit (VU)?
From March 27, 2020, for which must be issued a receipt of acknowledgment with the relevant folio, which the importer must declare in the customs declaration.
What are the requirements are subject to compliance in the import applications of the Certification Body or Verification Unit?
The CB and VU must register the applications in compliance with the requirements of the Customs-Standards System, and the folios of the applications must contain in their last characters the suffix “SOL.”
Is ts possible to import goods not listed in the Decree, paragraph V establishing several Sectoral Promotion Programs (PROSEC)?
Yes. Importers with Sectoral Promotion Program may import goods, even if they are not listed in paragraph 5 of the PROSEC Decree. They do not have to demonstrate compliance with Mexican Official Standards at the entry point into the country.
What happens if the product certificate is not obtained through the Certification Body or Verification Unit?
In this case, it will not be possible to continue importing with the folio provided by the CB or VU. The foregoing without prejudice to the authorities taking measures or ruling on the relevant sanctions in accordance with their respective attributions. Such measures or ruling must also be indicated by the CB or VU as soon as they detect the suspension or cancellation of the product certification process in order to carry out the relevant immediate deregistration.
