However, the National Banking and Securities Commission (CNBV) has faced several legal and operational challenges that have caused delays in the publication of the corresponding rules. These delays underscore the complexity and importance of regulation to ensure the sector’s sustainable and safe development.
Legal Challenges in the Implementation of Open Finance
Regulating open finance is a monumental task that requires the creation of a robust and adaptable legal framework. The CNBV’s challenges reflect the many legal and technical considerations that need to be addressed, including but not limited to the following topics:
- Equity and Access: It is essential that the new rules promote financial inclusion and do not reproduce or exacerbate existing inequalities. This includes ensuring that all players in the sector, from large banks to small fintechs, have equal access to the open finance infrastructure.
- System Interoperability: Successful implementation of open finance requires interoperable systems of various financial institutions. This involves establishing common technical standards that enable secure and efficient communication between platforms.
- Cybersecurity: With the increase in data interconnection, cybersecurity is becoming a top priority. Regulation shall include measures to protect against cyber-attacks and fraud, ensuring the integrity and reliability of the financial system.
- Regulatory Compliance and Money Laundering Prevention. Monitoring and analyzing transactions become more complex as data is scattered across multiple platforms, creating the need for institutions to constantly develop and update their monitoring systems to detect unusual patterns of behavior that could indicate money laundering or terrorist financing activities.
- Inter-institutional Collaboration. Cooperation between financial institutions and regulators shall be encouraged to share practices and develop common standards.
- Data Protection and Privacy: The interconnection of financial data between various entities raises significant privacy and personal data protection concerns. The rules must include clear and effective provisions to ensure that user information is adequately protected.
Importance of Regulation for the Future of the Fintech Sector
Effective regulation of open finance is fundamental for developing the fintech sector in Mexico. From a legal standpoint, its importance is manifested in several key aspects:
- Consumer Confidence: Clear and robust regulation is essential to building and maintaining consumer confidence in the digital financial system. Users must feel confident that their data is protected and can benefit from the new services without risk.
- Innovation and Competition: Well-designed rules can foster innovation by allowing new companies to enter the market and compete on a level playing field, recognizing the differences and characteristics of the entities involved, and establishing a level playing field of requirements and processes for all entities. This may result in more diverse financial products and services tailored to consumers’ needs.
- Financial System Stability: Regulation should ensure that adopting emerging technologies does not compromise the financial system’s stability. This includes systemic risk management and adequate supervision of participating entities.
- Regulatory Compliance: FinTechs and other institutions should ensure compliance with the new rules to avoid sanctions and maintain their reputations. This includes adapting their internal policies and continuously training on regulatory issues.
