The Digital Transformation of Legal Compliance in Mexico

BANKING AND FINANCE / by Miguel Gallardo Guerra

In recent years, regulatory compliance in Mexico has undergone a profound transformation driven by digitalization. This evolution has not only changed the way financial institutions interact with regulatory authorities, but also the role that lawyers must play in supporting them through this process.

Demands for transparency, traceability, and efficiency have led banks, SOFOMES, SOFIPOS, fintech companies, insurers, and other players in the financial ecosystem to adopt technological tools that were previously considered optional. Today, the automation of regulatory reporting, the use of artificial intelligence for risk detection, and the implementation of digital know-your-customer (e-KYC) processes are essential elements for ensuring effective compliance.

From a legal practice perspective, we have observed how the concept of “compliance” has evolved from being merely reactive to becoming a strategic and preventive function. Lawyers are no longer just those who interpret the law, but those who help integrate it into digital workflows, automated contracts, and constantly evolving technological architectures.

However, this transformation also presents new challenges. Regulatory gaps regarding technological innovations, the ethical use of AI tools, cybersecurity in the protection of sensitive data, and the need to align outdated legal frameworks with digital realities are issues that require constant legal monitoring.

At Bello, Gallardo, Bonequi & García, SC (“gbg”), we have supported this transition by advising our clients on the implementation of solutions that comply not only with the law, but also with the principles of accountability, sustainability, and trust demanded by today’s digital environment.

This article kicks off a series in which we will examine, from both legal and technological perspectives, the main challenges facing the Mexican financial sector in the area of digital compliance. We will explore topics such as the use of biometrics, smart contracts, the regulatory sandbox, and the legal implications of using artificial intelligence.

Because compliance, in the digital age, isn't just changing—it's being redefined.
