BANKING AND FINANCE / by Miguel Gallardo Guerra

Economic globalization requires Mexican law firms to operate not only within the national legal framework but also to understand and apply international regulations, particularly in the areas of trade, intellectual property, and anti-corruption regulations. This requirement is particularly relevant for the fintech, banking, and financial sectors, where cross-border transactions and regulatory interoperability are critical components.

Internationalization and the adoption of global legal standards are fundamental processes in the era of globalization. These processes facilitate cross-border commercial transactions and investments, promoting consistency, predictability, and fairness in global economic relations.

In the context of legal internationalization, global regulations serve as a bridge between different national legal systems, enabling greater economic and social integration. The harmonization of laws and legal practices reduces barriers to trade and investment, providing a framework of legal certainty that is essential for businesses and individuals operating in a globalized environment.

The adoption of international treaties, compliance with global standards, and participation in international organizations are key elements in enabling countries to establish common standards. These actions not only benefit the global economy but also promote human rights, environmental protection, and sustainable development.

However, the implementation of global regulations in the legal sphere presents challenges. The diversity of legal systems and legal cultures can complicate the harmonization process. Furthermore, there is concern that global regulations may be imposed at the expense of national sovereignty or that they may not adequately reflect local needs and values.

To address these challenges, it is crucial that the process of internationalization and the formulation of global regulations be inclusive and transparent, allowing for the participation of a wide range of stakeholders, including developing countries, civil society organizations, and the private sector. It is also important to ensure that global regulations are flexible and capable of adapting to different national contexts.

In conclusion, internationalization and global legal standards are essential for facilitating international cooperation and promoting equitable global development. However, for these processes to be effective and fair, they must be managed in a way that respects the diversity and sovereignty of nations, while seeking to achieve common goals for the benefit of the international community as a whole.
