Declaration of a Public Health Emergency and Extraordinary Measures in Mexico

Information note

On March 30, 2020, the General Health Council published in the Federal Official Gazette (FOG) the resolution by which the Council declared a public health emergency due to a force majeure caused by the SARS-CoV-2 (COVID-19) virus outbreak. The second provision of the resolution established that the Ministry of Health would determine all necessary measures to address the emergency[1].

 


In accordance with the foregoing, on March 31, 2020, the Ministry of Health published in the Official Gazette the Agreement Establishing Extraordinary Measures to Address the Health Emergency Caused by the SARS-CoV-2 Virus[2].

The extraordinary measures that the public, social, and private sectors must take to address the health emergency caused by COVID-19 can be summarized as follows:

  1. 1. Suspension of non-essential activities from March 30 to April 30, 2020

 

  1. 2. The following are essential activities:
  2. a) Activities in the medical, paramedical, administrative, and support fields throughout the National Health System (supply, production, manufacturing, services, and suppliers for the pharmaceutical sector, as well as cleaning and sanitization for medical units at various levels of care);
  3. b) Public safety and citizen protection, the administration of justice, and legal matters;
  4. c) Economic sectors: finance, tax collection, energy, gas stations or gas plants, drinking water, the food industry and non-alcoholic beverages, food markets, supermarkets, self-service stores, grocery stores, and the sale of prepared foods; passenger and cargo transportation; agriculture, fishing, and livestock production, agroindustry, the chemical industry, and cleaning products; hardware stores, delivery services, private security; daycare centers and childcare facilities, nursing homes and senior living facilities, shelters for refugees, and support centers for women who are victims of violence and their children; telecommunications and media; private emergency services, funeral and burial services, storage services, and cold-chain logistics for essential products; logistics (airports, ports, and railways); and
  5. d) Government social programs

 

  1. 3. Stay-at-home orders from March 30 to April 30, 2020 (voluntary restriction on movement).

 

  1. 4. Strict shelter for the elderly, pregnant women, women in the postpartum period, or individuals diagnosed with diabetes mellitus, high blood pressure, heart disease, chronic illness, immunosuppression, or kidney or liver failure.

 

  1. 5. Censuses and surveys have been postponed.

 

It was also determined that, as long as a public health emergency persists, the General Health Council will consist of the heads of the Ministry of the Interior, the Ministry of Foreign Affairs, the Ministry of National Defense, the Navy, the Ministry of Citizen Security and Protection, and the Ministry of Labor and Social Welfare.
