Bello, Gallardo, Bonequi y García, S.C.(hereinafter “bgbg”) is the data controller for your personal data. Bgbg designates the following address for service of process and receipt of notifications: Avenida Santa Fe, No. 428, Tower 1, 14th Floor, Cuajimalpa de Morelos Municipality, Postal Code 05348, Mexico City, Mexico.

Cada red social es responsable del tratamiento de los datos personales de sus respectivos usuarios, a quienes les deberá proporcionar su propio Aviso de Privacidad, el cual debe ser aceptado al momento de crear una cuenta. Bgbg es ajeno a dicho proceso de registro.

Bgbg trata los datos personales de los titulares en su calidad de usuarios de redes sociales, al acceder y gestionar la información que estos publican o comparten a través de los perfiles que han creado en las distintas plataformas, siempre y cuando estos interaccionen con bgbg o se comuniquen mediante mensajes directos, publicaciones, comentarios y menciones.

Los titulares, en su calidad de usuarios de redes sociales, son responsables del nivel de divulgación de su información y de los permisos que otorgan a terceros para acceder a sus perfiles y contenidos.

Para el cumplimiento de las finalidades informadas en este Aviso de Privacidad, bgbg tratará las siguientes categorías de datos personales: • Datos identificativos y de contacto.

1. Identifying and contact information.
2. Datos de imagen fotográfica y videograbada.
3. Datos de características personales.
4. Datos de circunstancias sociales.
5. Datos académicos y profesionales.

In order to fulfill the purposes set forth in this Privacy Notice, bgbg does not process sensitive personal data.

Bgbg will process your personal data for the following purposes:

Finalidades primarias:

1. Gestionar, atender y responder interacciones públicas o privadas realizadas a través de las redes sociales oficiales de bgbg, incluyendo comentarios, reacciones, menciones, publicaciones compartidas y mensajes directos.
2. Acceder y gestionar la información que los usuarios de redes sociales hayan hecho pública a través de sus perfiles, cuando dicha información sea relevante para la interacción o comunicación con bgbg.
3. Atender dudas, comentarios, solicitudes de información o aclaraciones relacionadas con los contenidos publicados por bgbg en redes sociales.
4. Difundir, comunicar y atender a consultas relacionadas con las dinámicas, concursos, eventos y talleres organizados por bgbg.
5. Proporcionar las bases e información pertinente sobre las dinámicas, concursos, eventos y talleres a los participantes.
6. Verificar que los participantes cumplan con los requisitos establecidos en las bases de participación.
7. Facilitar el procedimiento de registro de los participantes.
8. Tramitar la inscripción y gestionar su participación en las dinámicas, concursos, eventos y talleres de bgbg.
9. En su caso, gestionar la entrega del o de los premios a los que se hayan hecho acreedoras las personas participantes que resulten ganadoras.
10. Mantener comunicación por medios físicos o digitales (con la gestión de listas de contactos de correo electrónico), entre el participante y bgbg.
11. Fines estadísticos e históricos de los participantes.

The primary purposes of personal data processing listed above do not require your consent, as they fall under the exceptions set forth in Article 9 of the Law, in accordance with Article 15, Section III.

Finalidades secundarias:

1. Toma de fotografías y/o videos que se utilizarán para promoción, información y divulgación de las dinámicas, concursos, eventos y talleres de bgbg en varios medios, incluidos impresos, electrónicos y redes sociales.

You may object to the processing of your personal data for secondary purposes at any time after accepting this Privacy Notice, by following the procedure outlined in the “ARCO Rights” section.

Your personal data may be transferred within or outside of Mexico to the recipients and for the purposes identified below:

• Administraciones y autoridades federales, estatales y/o municipales; comisiones; institutos, entidades reguladoras; autoridades judiciales o administrativas; y entidades gubernamentales nacionales y/o extranjeras; en cumplimiento de obligaciones establecidas en la legislación aplicable y/o de requerimientos fundados y motivados efectuados por cualesquiera de dichas entidades.
• Instituciones educativas, asociaciones y/o aliados con quienes se tengan celebrados convenios, con la finalidad de comunicarles su registro, confirmación y participación en nuestras dinámicas, concursos, eventos y talleres.

The transfers of personal data described above do not require your consent, as they fall within the exceptions set forth in Article 36 of the Law. Any transfer of your personal data that does require your consent will be disclosed in advance through the appropriate notice and by updating this Privacy Notice.

As the subject of personal data, you may exercise any of your rights of access, rectification, erasure, or objection (hereinafter, “ARCO Rights”). These rights include:

• Acceso: el derecho que tiene a conocer qué datos tenemos de ti, así como para saber cómo los usamos o compartimos.
• Correction: the right to request, at any time, the correction of any of your data that is inaccurate or incomplete.
• Deletion: the right to have the processing of your personal data ceased, beginning with the blocking of such data and followed by its deletion.
• Right to object: the right to object, on legitimate grounds, to the processing of your personal data.

To exercise any of your ARCO rights, you may submit a request by sending an email to datospersonales@bgbg.mx

Your application must include:

1. Your full name and address, or another way to receive a response to your request.
2. A copy of a document proving your identity and, if applicable, proof of legal representation if someone is exercising this right on your behalf.
3. A clear and precise description of the ARCO rights you wish to exercise and the personal data related to your request; and
4. If applicable, any other information or documents that help us identify your personal data or support your request in cases where you are requesting a correction or objecting to the processing.

Bgbg will respond to your request within 20 (twenty) business days of the date it is submitted and received. If the request is deemed valid, we will process it within 15 (fifteen) business days of the date we communicate our response. If the information and/or documentation provided in your request is incomplete, erroneous, and/or insufficient, or if the necessary documents to verify your identity or legal representation are not included, we will request that you correct and remedy these deficiencies so that we may process your request. You will have 10 (ten) business days to comply with the request and correct the application; otherwise, it will be deemed not to have been submitted.

The use of electronic means to exercise your ARCO rights authorizes bgbg to respond to your request via the same means, unless you clearly and explicitly specify another method of contact in your request.

The right to erasure is not absolute. Please note that bgbg must retain certain information to comply with various legal obligations and, in doing so, may share your personal data with other entities or organizations. In such cases, you may need to exercise your right to erasure by contacting the entity that received your personal data.

In some cases, you may withdraw your consent to the processing of your personal data; however, this withdrawal cannot have retroactive effect, meaning it cannot affect situations, procedures, or transfers that took place before you withdrew your consent.

Please note that there may be public policy provisions requiring bgbg to retain your information for a minimum legal period; in such cases, we will retain your information solely to comply with those legal provisions.

Puedes limitar el uso o divulgación de tus datos personales dirigiendo la solicitud correspondiente a nuestro Departamento de Datos Personales, siguiendo para tales efectos el procedimiento y las instrucciones aplicables al ejercicio de los Derechos ARCO.

Bgbg cuenta con medios y procedimientos para asegurar la inclusión de algunos de tus datos en listados de exclusión propios, para evitar que tus datos sean divulgados. En tales casos, otorgaremos a los titulares que soliciten su registro, la constancia de inscripción correspondiente.

You may restrict the use or disclosure of your personal data by submitting a request to our Personal Data Department, following the procedure and instructions applicable to the exercise of ARCO rights.

Bgbg has the means and procedures in place to ensure that certain data is included in its own opt-out lists, thereby preventing the disclosure of such data. In such cases, we will provide data subjects who request to be added to the list with the corresponding proof of registration.
