According to one client, Bello, Gallardo, Bonequi y García, S.C. is ‘the best TMT firm in Mexico’. The 15-strong team has been building its specialised practice for almost 20 years, having grown together with some of Mexico’s TMT operators, and focusing its activity primarily on regulatory and compliance work. The firm has also been developing an associated data protection and privacy practice; notably, with Hector Guzman, partner of the firm’s data protection and privacy practice being based in Madrid, the firm started advising Mexican subsidiaries of European companies on complying with the international requirements of GDPR a full year before it came into force in May 2018. In one of the year’s highlight cases for the firm, the team provided regulatory advice to Altán Redes, following its successful bid to use 90MHz of spectrum in the 700MHz frequency band for wholesale services to be launched in 2018. In other work, it assisted global telecoms provider CenturyLink with a variety of legal issues, including regulatory compliance matters related to the restructuring of the company’s subsidiaries in the country and which involved transferring several licences and transitioning from a public telecommunication network concession to a sole concession under the recent Federal Telecommunications and Broadcasting Law. ‘Very sharp’ practice head Carlos Bello ‘is recognised by everyone involved in the industry’, says one client, adding that ‘this brings amazing added value to any work performed in Mexico’. Noted for his ‘perfect understanding and knowledge of the market and of his clients’, as well as for his ‘proactivity in finding solutions and working to reach his clients’ goals’, Bello advised Concesionaria Comseg, part of Grupo Seguritech, on the public auction of spectrum for private radio communication services, of which the client won almost 2/3 of the spectrum auctioned. Bello was assisted by new partner Rolando Guevara, one of the practice’s bright young stars, in advice to regular client Echostar regarding concentration accusations related to Dish Mexico, of which the client is a partner; in what was a very high-profile $300m case, the lawyers won a constitutional action on their clients’ behalf. Guevara also assisted Hughes Network Systems, a subsidiary of Echostar, with procedures to obtain VSAT licences in nine Latin American countries of a Comprehensive Nuclear-Test-Ban Treaty Organization (CTBTO) project which is seeking to establish and begin the provisional operation of an International Monitoring System (IMS). In addition to its ‘excellence’, the team also distinguishes itself throught its ‘dynamism’, which, according to one client, can be attributed to its solid second line of younger lawyers. Singled out among these is senior associate Carlos Díaz, who is noted for his ‘broad knowledge of the issues, good communication across all channels and personalised service’. Another key practice figure Federico De Palacio handles telecoms and corporate matters. The practice counts several mobile virtual network operators (MVNOs) among its client-base, including ACN, Plintron, and Mobilebandits; other clients include Tele Fácil, Cisco, Kymeta, Bosch, Huawei, Globalstar de Mexico, T-Systems Mexico, Aquto, Lycamobile, Skype and Microsoft.

Bello, Gallardo, Bonequi y García, S.C.’s expertise in regulatory and compliance work is ever more in demand as Mexico’s banking market becomes increasingly preoccupied with this side of business and financial institutions seek to strengthen their compliance solidity; in some cases, entire BGBG teams integrate banks’ structures as their compliance departments. In this vein, under a secondment scheme, the firm gave day-to-day legal and compliance support to Deutsche Bank’s local brokerage arm regarding all its business lines, as well as to Deutsche Bank Mexico, with recent activity including assisting the client with important regulatory changes in the Mexican market, notably those relating to anti-money laundering, money transfer systems, and securities intermediation. The team does similar work for long-term client Bank of Tokyo-Mitsubishi, while also providing assistance on transactional operations. Other matters included advising Morgan Stanley on a variety of banking and finance matters and it was recently hired by Scotiabank for similar services. Compliance and AML expert Miguel Gallardo leads the 19-strong team, which includes Juan Carlos Tejado (who also covers capital markets), senior associates Marco López (AML and compliance) and David Durán (finance, banking and securities), and senior counsel Adolfo Hegewisch, who, on secondment, acts as head of the legal and compliance area of Deutsche Bank México. The firm’s role advising Sofomes (Sociedades Financieras de Objeto Múltiple), small regulated and unregulated non-banking financial institutions, is also of note. Additionally, in a significant recent development, the firm opened a Queretaro office under the leadership of senior associate Samuel Rivero in late August 2018. It advised Total on its master agreement for the $400m incorporation of over 200 fuel stations under the Total brand, and also advised Iberdrola on National Content regulations required for the construction of two combined-cycle power generation plants. Bello, Gallardo, Bonequi y García, S.C. draws on its corporate and regulatory and compliance expertise to advise insurance clients on all sorts of matters related to their business operations. Leading the firm’s roster of clients is AON, which the department assists with insurance and reinsurance regulatory requirements, corporate matters and compliance issues. Other recent work highlights included advising Sedna Hospital on the due diligence procedure carried out on its insurance programme and assistance to INTERprotección regarding data protection and privacy compliance, another one of the firm’s strengths. The team of eight is co-led by Miguel Gallardo Guerra, who is certified by the National Insurance and Bonding Commission as an insurance contract expert and sits on the Board of Directors of Sura Seguros as an independent member. Sura, another one of the practice’s clients, instructs the team on corporate, compliance and insurance law matters. Gallardo’s fellow practice head is Federico de Palacio (also a member of the firm’s corporate group), and the team also calls on the support of data protection and privacy partner Hector Guzman and of senior associate Javier Pérez Moreno.
